Locality Rule in Nebraska - It exists and it might sink your case

The Nebraska Supreme Court recently upheld the locality rule when it reaffirmed the lower courts ruling in Carson v. Steinke, 314 Neb. 140 - Neb: Supreme Court 2023.


Carson was a birth injury case out of Grand Island, NE. Plantiffs expert was from Cedar Rapids, IA. The Court ruled the plaintiffs expert couldn’t testify to the “Grand Island” standard of care. After seven years and a lot of invested time and money this case was over without justice for my client.


All Nebraska medical negligence cases from this date forward have to comply with the locality rule or risk being dismissed.
